 Post subject: Foreign spouse's share of property

Hi I am married to a Turk and I need some clarifications on the following:

1. Is it true that after 2002, any property acquired are to be shared
between the spouse and his children (previous marriage)?

2. At any time, can my husband transfer the property to his children
without the consent of the spouse?

3. Can the spouse put an injunction that the property cannot be
transferred?

For inheritance purpose the property goes to the spouse and all surving children. I f thats what you mean by the question.

2. At any time, can my husband transfer the property to his children
without the consent of the spouse?

Answer yes if its only his name on the Tapu

3. Can the spouse put an injunction that the property cannot be
transferred?

Answer yes but much easier done if spouse consent otherwise you have a legal problem which will need a good lawyer.

Hi Bryn

Thanks for your reply. Sorry to have to post more questions but I would appreciate any information given.

1. As we don't have any children of our own, do you think I should have a will done to pass my part of the property to my sisters. That is assuming that the property is rightfully mine after my husband's death?

2. If I do need to do a will, would any lawyer be able to do this?
